These Conditions of Sale apply to all sales transactions with Clear Display, including online sales from www.clear-display.co.uk or any other website operated by the Company, whether sales orders are placed electronically, by phone, fax or by mail.
These Terms and Conditions apply to all transactions on this site. Please read them carefully. They do not affect your statutory rights.
We may change these terms and conditions at any time. Any changes will take effect on the date they are posted onto the site (see date above). You will be asked to read and accept the terms and conditions each time you place an order, to ensure that you are familiar with the most current ones.
Please note that different terms (including prices, delivery charges, delivery times and returns policies) may apply to purchases made in one of our stores.
Accessing the pages within this site signifies your agreement to the following terms and conditions of use regarding this site and its content. We are principally a B2B supplier: whilst the Company mainly offers its products and services to businesses and organisations rather than to consumers, nothing in these Terms and Conditions should be taken to limit a consumer’s statutory rights.
Our Contract
You will have an opportunity to check and correct any input errors in your order up until you click the Submit Order button.
After you submit an order we will give you an Order Reference Number and details of the products you have ordered.
Acceptance of your order and the creation of a legally binding contract between us will occur when we send you an email advising you that your products will be delivered to you. (Alternatively, we may decline all or part of your order for any reason, in which case we will call/email to tell you so) When deciding whether or not to accept your order we may use certain information about you, including any received from credit reference agency checks with Nochex or other agencies. In particular, we may pass your details to Nochex for them to check against certain public and private databases. Nochex may keep a record to use in future security checks. This helps to protect you and us against fraudulent transactions.
We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method or suggest that you visit one of our stores. Please note that products, prices and offers in our stores may differ from those featured on this site.
Before using any of our products, the customer shall determine the suitability for its intended use. Any decisions based on information contained in this site or in our brochures are the purchaser’s responsibility. If in doubt please call and we will do our best to advise. However, advice as to suitability given over the phone should be regarded as general guidance and may not take account of the customer’s exact situation or circumstances.
Clear Display makes no representations or warranties of any kind, express or implied, about the information provided in this site.
Prices and Payment
All prices and charges on this site are in UK pounds – they ALL EXCLUDE VAT. All products also exclude delivery charges unless stated (see Delivery section for details).
The total cost of your order will be the price of the products you order, plus the applicable delivery charge and VAT. All these will be set out clearly in your Shopping Basket before you submit your order.
Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If something becomes unavailable we may offer you an alternative or suggest that you visit one of our stores.
We try very hard to ensure that all information on this site is accurate. However, just occasionally, an error can occur. If we discover an error in the price or description of a product you have ordered, we will tell you and ask you whether you wish to continue with your order or cancel it.
We accept payment by Mastercard, Visa, Delta, Switch, Maestro, Solo, Visa Debit. Payment is deducted when we process your order.
Where We Deliver
Our Standard Delivery must be to an address in the United Kingdom (but excluding the Channel Islands and, for some larger items, the Isle of Man, Anglesey, The Scilly Isles and the Scottish islands). Other destinations by telephone request. All deliveries must be signed for (except items sent by post and which are small enough to be put through your letterbox). Please make sure you keep the receipt enclosed with your goods.
Next day delivery is not guaranteed and is suitable for UK addresses with these exclusions: Northern Ireland, Scottish Highlands & Islands, Isle of Man, Isle of Wight, Isles of Scilly and other off-shore islands Scottish Highlands and Islands include postcodes beginning with PH19 to 44, 49 and 50, IV, KW, PA20to 88, ZE, KA27, KA28 and HS
Delivery Charges
We make every effort to keep our delivery charges as low as possible. Our charge depends on the type of product ordered and whether you choose standard delivery (1-5 working days) or free delivery.
The applicable standard delivery charge is shown in the checkout. There are additional charges if you choose a premium delivery service. You will always be able to see all applicable charges before submitting your order. Also we offer free delivery on some goods - this will be clearly shown on in the checkout.
How we Deliver
Smaller orders are generally delivered either by courier or by post. If your product is one which is delivered by courier, you may be given the option of choosing a premium delivery service for a small extra charge during the order process.
For these larger products you will be asked or told about delivery dates for standard delivery as part of the order process. We will notify you which delivery method we will use when we send you our third e-mail. Very occasionally different products in the same order may be delivered separately.
We shall not be responsible for loss arising from delay or failure to deliver arising from causes beyond our control. These include Act of God, war, civil disturbance, riot, industrial action or dispute, natural calamity, controls, restrictions or prohibitions of Government or other competent authority, fire, flood, sabotage or non-availability of materials.
Delivery Times
Delivery times are calculated in working days - i.e. Monday to Friday inclusive (but excluding Bank Holidays). If you order after 12.00pm, please calculate your delivery time as if your order had been placed the following working day.
Any dates and times quoted for delivery are to be treated as an estimate and the Company shall not be liable whatsoever for failure to deliver by such date or time.
Standard Postal and Courier Deliveries, normally 1-5 Working Days
Standard postal and courier deliveries should arrive within 1-5 working days of placing your order (to be safe, please allow a little extra during busy sales periods).
If we are sending your product by courier, standard courier deliveries are usually made between 9am and 5pm. All deliveries must be signed for. If you are out when the courier arrives, the courier will leave a card with a contact number for you to call. IMPORTANT: We do everything we can to meet the delivery times specified in this section. However, occasionally delivery times may be affected by factors beyond our control and therefore they cannot be guaranteed. We will inform you if we become aware of an unexpected delay.
Please allow extra time for deliveries to Scottish islands or if you apply for credit (we need to receive your signed application form back before we can process your order; this can add 5 working days).
Quotations
All quotations made are applicable only to quantities specified and are valid for 30 days from the date of quotation. The Company reserves the right to increase its price to take account of variations in labour, material or other costs between the date of quotation and the last date of delivery of the goods.
Retention of Title
Goods shall remain the property of the Company until payment in full has been received. Until title to the goods passes to the Customer he shall hold the goods for the Company and shall store the goods in such a manner as they are readily identifiable as the property of the Company. Ownership of all tooling and film positives rests with the Company.
Intellectual Property
Ownership of all intellectual property rights in relation to design work carried out by the company rests with the company unless otherwise provided for by a separate agreement.
Colours viewed on a computer monitor or in our printed catalogue should not be relied upon as a true representation of actual colours. We do not give any warranty as to uniformity of shade or exact colour shade of the products. A reasonable variation between batches of the same products will be deemed acceptable.
Missing, Damaged or Incorrect Orders
We try very hard to ensure that you receive your order in pristine condition. In the unlikely event that a product arrives damaged or faulty, please see the details below on damage or loss of goods in transit.
Verbal orders must be confirmed in writing within 24 hours. All orders placed either online or via phone, email or fax will be subject to a final acceptance by the company
If the Customer cancels a specially manufactured or customised order before its completion he shall become liable to pay to the Company a sum equal to the cost of the labour, materials and overheads expended in the execution of the said order, up to the date of the receipt of such cancellation, plus the profit which the Company would have made but for such cancellation. This shall not apply to finished products normally held in stock by us.
The Customer should notify, in writing, the Company and the Carrier within 24 hours of delivery, any damage or loss of goods in transit. Non-delivery should be notified in writing within 7 days of the date of invoice. No claims will be valid outside of these times.
Payment
Where credit terms have not been agreed, payment should be made in full with order or, where appropriate, immediately prior to despatch of the goods.
Unless otherwise agreed, the Company's credit terms are 30 days nett. The Company reserves the right to demand immediate payment in full after giving notice of its readiness to deliver the goods and to charge the Customer any storage expenses it may have to incur, all such storage being entirely at the risk of the customer.
Defects
The Company shall not be under any liability to the Customer or to any third party in respect of defects in goods delivered whether patent or latent or for any injury, damage or loss resulting directly or indirectly from such defects howsoever caused. Without prejudice to the foregoing the Company reserves the right at its sole discretion to make replacement of goods or parts in respect of any complaint in writing relating to alleged defects received by the Company within one month of the date of delivery. The date of delivery for the purpose of this clause shall be the date of delivery to a carrier by the Company.
Returns
Returns for items that have not arrived damaged or are unwanted will be at the Managing Director’s discretion. All such returns will be subject to a 25% restocking and collection fee (There is a minimum charge of £25.00).
To be eligible for a return credit, all items must be in pristine condition and in original packaging and we must be notified in writing within 24 hours of receipt of goods. Items that are ordered as bespoke items or made to order items including any printed items (items with customer specific graphics) or other such items are not eligible for refund or return under any circumstance.
This Website
We, our Group company own the copyright, trademarks and all other intellectual property rights in all material and content on this website, which you may use, download, copy, publish, transmit or otherwise make available by any other means only for your own personal, non-commercial use. Any other use or reproduction of the material or content is strictly prohibited.
You may not create any link to this website without our prior written consent, nor may you restrict or inhibit the use or enjoyment of it by anyone else.
General
These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions. Your data protection rights are set out in our Privacy Policy.
These terms and conditions only cover the Clear Display website. Any other websites to which you link from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites which are not under our control. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.
